This is an action for wrongful death arising out of a collision between the plaintiffs decedents automobile and defendants log loader. Defendant filed a counterclaim for damages to its log loader. Oregons comparative negligence statute, ORS REF18.470,/REF was in effect at the time of the accident. The jury, by "SPECIAL FINDINGS OF FACT" (ORS REF17.415),/REF found that plaintiffs decedent was 56 percent negligent and defendant was 44 percent negligent.
