Louis Smedegard, the respondent employee, 64 years of age, was an employee of the appellant, Cutler-Hammer, Inc. In May 1955 at the end of a work day the employee on his way to punch a time clock descended a concrete stairway consisting of three steps which were in a straight line and measured about 20 from the top level to the floor. While proceeding down these steps he fell, striking his right shoulder on the steps or floor, which ultimately resulted in a 35% permanent partial disability. After falling the applicant went home because he felt it was only a trivial injury, but the next day he called the Cutler-Hammer medical department and was told to come in for treatment.
